I think there may be times it’s “justified”, but it’s incredibly expensive and doesn’t really make sense to implement. I think data shows it’s not a good deterrent as well. You can’t really make it less expensive since with something as irreversible as the death penalty you need to go through a very lengthy process to make sure you have the right person and they could merit capital punishment.
TL;DR, even if it might be justified it doesn’t really make sense to have on the books
